The activities of the State Register of Certificates of Registration of Copyright in a Work and the State Register of Contracts Concerning the Author's Right to a Work are provided for by the new Procedure for State Registration of Copyright and Contracts Concerning Proprietary Rights to a Work, which has not yet entered into force.
The holder and administrator of the state registers is UIPI. Accordingly, employees of UIPI are designated as creators of information on the objects of the state registers and registrars.
The sources of information in the state registers are the application, the applicant's petition, court decisions, decisions of the National Security and Defense Council of Ukraine on the application of personal special economic and other restrictive measures (sanctions) enacted by the Decrees of the President of Ukraine.
Thus, the following information is entered into the State Register of Certificates of Copyright Registration for a work, among other things:
- date and number of copyright registration for a work, which is the number of the certificate
- the date of publication of information on the issuance of the certificate and the number of the bulletin;
- date of final completion of the work and information on the publication of the work (if any);
- information about the author (co-author) of the work and the person to whom the certificate was issued;
- the essence of authorship, author's contribution to the creation of the work (author, co-author, compiler);
- data on the creation of the work (on the author's own initiative, in connection with the performance of duties under an employment agreement (contract), in connection with the fulfillment of an order agreement);
- information on the author's indication in the bulletin (under his/her own name, anonymously or under a pseudonym);
- information on the form and procedure for obtaining certificates.
In addition to the basic information on the author (co-author) of a work and the work itself, the following information shall be entered into the State Register of Contracts Concerning the Author's Right to a Work:
- number and date of signing and registration of the contract
- type and title of the contract;
information about the parties to the contract; - methods of use of the work, the property rights to which are transferred (granted) under the contract;
- territory (if any) and term for which the rights are granted under the agreement (for license agreements);
- information on the form and procedure for obtaining a decision on registration of the agreement.
It should also be noted that the Procedure for State Registration of Copyright and Agreements Concerning Proprietary Rights to a Work provides for the possibility of filing an application for state registration of copyright in a work and state registration of an agreement concerning the author's right to a work by the applicant personally or by the applicant's representative.
