The Ministry of Digital Transformation of Ukraine has developed a roadmap for legislative regulation of artificial intelligence (AI) in Ukraine. This is necessary to eliminate AI risks and develop it in the interests of the state, business, and citizens.

The roadmap is based on a bottom-up approach, which implies a step-by-step movement from smaller to larger and is based on the balance between business interests and ensuring an adequate level of protection of citizens from AI risks.

The first stage, extra-legislative, which is planned to be implemented within 2-3 years, envisages that businesses will be given the opportunity and tools to prepare for future regulation, the state will have time to understand the market, risks, and acquire the actual ability to implement the law (creation of a regulator), and citizens will be given awareness of the topic. In fact, this stage should include:

  1. building the capacity of the future regulator and preparing the industry for future requirements;
  2. creating an identical legal regime with the EU - simplifying access to the EU market, raising funds, finding partners, etc;
  3. Forecasting future requirements, i.e. creating a so-called White Paper that will provide answers to the question of what to do right now, familiarize businesses with the approach, timing, and stages of AI regulation implementation, and what to expect in the future;
  4. publication of general and sectoral guides, and companies are expected to sign voluntary codes of conduct that will demonstrate the ethical use of AI.

Ukraine's transition to the second stage involves taking into account the experience of the extra-legislative stage, preparing and adopting a law that will be analogous to the EU's Al Act. It is planned that the work on the draft law will start no earlier than 2024, namely after the adoption of the Act by the EU countries.

As stated in the roadmap, the Ministry of Digital Transformation aims not to regulate the AI sector in Ukraine, but to create a competitive environment where the interests of Ukrainian business will be protected.
